Lean Innovation Community: Terms and Conditions

These terms and conditions form the basis of the contract through which the Lean Analytics Association (LAA, we or us) will deliver a service to you as a Lean Innovation Community member (you, LiC member or member).  On becoming a member of Lean Innovation Community (LiC) you are automatically agreeing to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with the Data Protection Act.

Lean Analytics Association is a non-profit association which operates in accordance with the Articles 60 to 79 of the Swiss Civil Code, The Federal Assembly of the Swiss Confederation.

WHAT IS LEAN ANALYTICS ASSOCIATION?

The Lean Analytics Association (LAA) is a non-profit spin-off organization that connects innovation challenges to lean solutions through a network of international experts. LAA focuses on providing methods, tools, training and bespoke solutions. We also facilitate networking amongst practitioners towards the implementation of novel lean approaches and innovation best practices.

WHAT IS LEAN INNOVATION COMMUNITY?

The Lean Innovation Community is a membership-based service of Lean Analytics Association and is a community dedicated to forward-thinking people and businesses with a passion for lean innovation, with the desire to grow and continuously improve.

THE LEAN INNOVATION COMMUNITY MEMBERSHIP TERMS AND CONDITIONS

1.  Membership Benefits

The Lean Innovation Community offers two different Memberships:

  • Professional Membership (paid membership valid for 1 year from the day of payment)
  • Academic & Student Membership (discounted membership valid for 1 year from the day of payment)

The Lean Innovation Community also offers a:

  • Limited Access (free membership with limited access valid from the day of registration) account which is not considered a membership, but it allows for limited benefits which may include:
  • Limited access to LiC Knowledge Library and its content
  • Paid webinars with educational content
  • Subscription to the mailing list
  • The opportunity to attend events nationwide

For the promotional purposes of Lean Analytics Association and Lean Innovation Community we reserve the right to offer special type of membership, such as:

  • Trial Membership (Free trial of professional membership valid for 30 days from a successful registration. Trial membership is downgraded to the Free Access if it was not upgraded to Professional Membership prior to expiration date)

The Lean Innovation Community Membership provides a range of benefits but the access to benefits varies according to the membership category. Some of the benefits offered are:

  • Access to Lean Innovation Community’s Knowledge Library and its content
  • Exclusive, members-only discounts
  • Welcome package (at the time of first registration; in electronic form)
  • Free and paid webinars with educational content
  • Networking opportunity
  • Opportunity to share your knowledge/experiences with other members of LiC
  • The opportunity to attend events nationwide
  • Opportunity to become co-author of whitepapers, blogs or other LAA and LiC publications
  • Access to lean innovation glossary and reference list
  • Subscription to a mailing list

Membership packages may vary according to available material and partners agreements. We reserve the right to change the benefits that apply to Lean Innovation Community membership at any time and without prior notice.

Any external providers of a benefit included within your membership package will have absolute discretion in relation to the provision of services, and membership of LiC does not guarantee that the external provider will accept an application from a member for the provision of services.

Services supplied from an external provider will be subject to the external provider’s own terms and conditions, and we do not accept any liability for loss or damage suffered as a result of a fault, error or omission in the provision of these services.

We reserve the right to change our external providers without prior notice and our decision on services provided is final.

2.  The Membership Contract

When you submit a correctly completed application online, or by, post, or e-mail, and once your payment has been successfully processed, you are making an offer to subscribe to the Lean Innovation Community of Lean Analytics Association which, if accepted by us, will result in a legally binding contract.

At the point of renewal of your membership, your renewal payment is confirmation of the continued acceptance of this contract. You may not transfer any of your rights and obligations under these terms and conditions to another person.

Membership Duration and Renewal

The Professional and Academic & Student Memberships are valid for the duration of 1 year from the day of successful payment and can be renewed on an annual basis, to extend the duration of the membership. Lean Analytics Association will inform you of expiring membership 60, 30, 7 and 1 day before the membership expires, however, we reserve the right to change the amount of times and the times of when we inform you that your membership is due for renewal soon.

The Free Access Account is valid for the duration of 1 year from the day of successful registration and can be extended each year free of charge.

The occasional special types of memberships are non-renewable except if specifically agreed otherwise be both parties. In this case, the Membership Duration and Renewal terms are defined on the individual basis in written or verbal agreement.

Online application

For online applications, you will either have sight of a confirmation page or receive an email.  If you have supplied your email address, an acknowledgment that your application has been received and is being processed does not yet mean that the contract between us is formed.  A legally binding contract is formed on the date your payment is successfully processed.  A successful payment confirmation will be sent out when all the correctly filled registration form is submitted and payment of your membership is confirmed.

3.  Professional Development and Conduct

By proceeding with this application you are confirming that, as a member of the Lean Innovation Community, you will be committed to the development of others and that you intend to develop your lean and innovation skills, and professionalism continuously.

All Lean Innovation Community members agree and reaffirm their commitment on an annual basis.  Failure to adhere to the agreement, resulting in a formal complaint made against you, may result in a termination of your membership without the possibility for a refund of already paid membership.

4.  Right to refuse applications or downgrade applications

We reserve the right not to fulfill, or to cancel, your application if we are unable to obtain payment authorization from the issuer of your card or from your bank in the case of direct payments.  If you have been convicted of a criminal offense which is not yet spent, or have a prosecution pending, this must be declared.  A declaration must also be made of insolvency or undischarged bankruptcy.  Please note: this information will be treated in the strictest confidence and will only be taken into account if relevant.  Spent convictions under the Rehabilitation of Offenders Act need not be disclosed.

If you are accepted into membership, but it subsequently turns out that any or all of the information provided by you was misleading or false, we reserve the right to revoke the membership with immediate effect, without prior notice and without the right of appeal, refund or dispute.

Membership upgrades and upgrades due to special promotions or discounts are granted by our team.  We reserve the right to downgrade an application on the day your full or trial membership expires and the payment to renew it was not yet received.

5.  Cooling off period

Due to the high intellectual value and some proprietary information/documents are offered for free download to our members, we do not offer a cooling-off period. If you wish to cancel your new member subscription, you must notify us in writing, by letter or e-mail.  Cancellation policy is explained in section 6 of the Membership Terms and Conditions.

6.  Cancellations and Refunds

Your Lean Innovation Community Membership is an annual agreement which needs to be renewed upon the anniversary of your application.  You will receive a renewal notice in advance of the anniversary of your application date, informing you of your entitlement to cancel and/or change your personal and/or payment information.

If you wish to cancel your membership, you must inform us of your intention to cancel a minimum of 30 days prior to the anniversary of your application.  This notice should be provided directly to us, in writing by letter or e-mail.

No refunds will be provided unless the notice requirements comply with the above paragraph.

7.  Price Information

Fees displayed in the membership section of the website will prevail at all times in relation to orders placed online.

Fees displayed on an application form, or quoted by an LAA representative, will prevail in relation to membership subscriptions placed verbally or by post.

You may make a one-off payment for a one-year membership subscription, new or renewal through PayPal, with PayPal Account, or by credit/debit card, or through bank transfer.

We reserve the right to increase the price of any memberships on an annual basis.  You will be informed of any fee increase within your renewal letter/e-mail.  If we discover an error in the price of your membership subscription, we will inform you as soon as is reasonably possible.

Fees are for individual membership only.

8.  Membership Payment

If you are not using your own PayPal Account or credit/debit card to pay for the membership, you must ask the permission of the credit/debit card holder before entering the payment details.

When you offer to register to the Lean Innovation Community either online or by post, you are confirming that you have obtained the express prior permission of the credit/debit card holder.

9.  Liability

Our liability to you will not extend to any membership related benefits, goods or services provided by an external provider.  We specifically exclude liability for any loss or damage suffered by you as a result of your involvement in whatever manner with an external provider.

Every effort is made to ensure the accuracy of our publications and any other journals; however, neither we nor the authors can accept liability for errors and omissions within the publications.

These Terms and Conditions do not and shall not affect your statutory rights as a consumer.

 

10. Information Services

Diligence and care should be taken when using the information provided.  All services are subject to copyright law.  We use our best endeavors to ensure all information provided by us is as up to date as possible.  However, you should not rely on the information provided as the sole basis for making business, legal or other decisions.  You should seek appropriate independent advice before making any such decisions.

The content of all Lean Analytics Association and Lean Innovation Community publications represent the opinion of the author and not necessarily of the association or community in general.

11. Data Protection and use of Personal Data

The Lean Analytics Association is the Data Controller and Data Processor of any personal data you supply.
When you become a member, we collect information about you including (but not limited to) your name, your company name, your work address, and job title. We may also collect your personal email address and a mobile phone number. Members may voluntarily provide additional information in their membership profile; such as information about social media profiles, other topics of interest and years of experience. Finally, we will ask if you agree that we display your organization logo. Members may edit their profile at any time to change, add, or remove personal information.

The personal data you supply will be used to process your membership. As a member of Lean Innovation Community, your data will be used for marketing, statistical and analytical purposes and to administer your membership. You will receive membership communications and from time to time we will let you know about our promotions. If you provide us with your e-mail address, then we may send information which may be of interest.

We do not pass your personal information to any third party for the purposes of marketing or promotion. However, we do use third parties like PayPal for payment processing, and shipping service companies for processing and handling of your order made through Knowledge Library or Shop. Only the absolutely necessary information is shared with these companies in order to enable our services. We do not take any responsibility for how the third parties handle, use, and store your personal information.

If you believe that any of the information we hold concerning you is incorrect or out of date, please provide us with the accurate information at the email address provided at the end of this page.

Under the General Data Protection Regulation, you have the right to:

  • Access your personal data and update your preferences
  • Rectify, ensure or restrict the usage of your information
  • Object to the processing of your information
  • Data portability

12. Data protection via the website

We will make every effort to ensure that the information on our website is accurate.  However, we cannot guarantee this and accept no liability for any information given via Lean Analytics Association and Lean Innovation Community website.

Even if data encryption is used, the security of information transmitted via the internet cannot be guaranteed.  Any losses incurred or sustained by users who transmit information by electronic means shall be borne solely and exclusively by such user and in no event shall any such losses in whole or in part be borne by us.

13. Events

Members may be invited to events organized by us or our partners, to enable members to gain information and make the best use of networking opportunities.

Cancellation policy is typically defined for each event individually. In case that the event is organized and held by Lean Analytics Association and no specific cancellation policy is defined for this event, the following policy applies:

Cancellations made 30 days or more before any chargeable event will be refunded in full.  Cancellations after that date will be charged in full, although substitute attendees can be made at any time.

The Lean Innovation Forum is subject to separate terms and conditions.  Please check these at the time of booking.

14. Variation

The Lean Analytics Association reserves the right to amend these terms and conditions at any time.

The most recent edition of these terms and conditions will be binding upon you.

Members may exit the contract without penalty if they do not accept any proposed variation.

15. Prize Draw and Competition Rules

All prize draws and competitions which are associated with our offers are subject to separate terms and conditions, as written at the time of the prize draw, competition or offer.  Prize draws are not open to employees or contractors of the Lean Analytics Association.

16. Governing Law and Jurisdiction

These terms and conditions are governed by the Swiss law.  You hereby irrevocably submit to the exclusive jurisdiction of the Swiss courts notwithstanding the jurisdiction where you are based.

If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

17. Third parties

A person who is not a party to these Terms shall not have any rights under or in connection with them under the CC 235.1 Federal Act of 19 June 1992 on Data Protection (FADP).

18. Entire Agreement

These terms and conditions override any contrary terms or conditions published by us in relation to any membership between you and us.

19. Lean Analytics Association and Lean Innovation Community Brand

Use of our logo is allowed for the promotional purposes of Lean Analytics Association and Lean Innovation Community or any related products/services if the highest possible quality is guaranteed and under consideration that the logo has not been changed in whole or partially.

20. Queries Comments and Complaints

We will respond to any complaint or query received within five working days. This may be an acknowledgment that we have received a complaint whilst further investigations are carried out.
